Plea against defection by MLAs in 2019 listed by SC for ‘academic’ purpose

The Supreme Court of India has listed for Tuesday the challenge by former Goa Congress President Girish Chodankar, against the Goa Speaker’s order rejecting his plea for disqualification of the 10 former Congress MLAs who defected to the ruling Bharatiya Janata Party (BJP) in July 2019 for ‘academic’ purpose only.

Chodankar is being represented in the Special Leave Petition by senior Congress leader P Chidambaram, When it was last heard, the Supreme Court had termed the issue had become “academic” in view of the subsequent election of the Goa legislative assembly in 2022, Chidambaram conceded the turn of events but argued that it still be listed and decided for “future guidance”.

“Only for the purpose of deciding the issue academically and it is observed that the final outcome in the present Special Leave Petition may not affect the subsequent election and/or even earlier, issue notice returnable on 15.11.2022,” the court ruled.

The Assistant Registrar of the Supreme Court has therefore listed the matter.
