Luthra brothers’ 48-hr transit remand came with strict directions to police

Court orders medical checks, access to lawyers and basic facilities during transfer

As the Luthra brothers are set to arrive in Goa at 10.40 am on Wednesday, a Delhi Patiala House court on Tuesday granted the Goa Police two days of transit remand in connection with the Birch fire tragedy.

The accused were produced before Judicial Magistrate Twinkle Chawla. The Goa Police had sought three days of transit remand to bring the accused to Goa and complete legal formalities. However, the court allowed only two days.

During the hearing, the accused did not oppose the transit remand. Their lawyer told the court that they have reserved the right to challenge the legality of the arrest, the sections applied under the Bharatiya Nyaya Sanhita (BNS), and to seek bail before the appropriate court in Goa.

While granting the remand, the court issued clear directions to ensure the safety and well-being of the accused during transit. It ordered that medical examinations be conducted within 12 hours and again after they are produced in Goa.

The court also allowed family members to provide basic items such as clothes, spectacles and slippers, and directed that prescribed medicines be given. Access to legal counsel was also ensured, if required.

Outside the court, Gaurav Luthra folded his hands when reporters asked if he regretted the incident. Sources said the accused became emotional on seeing their family members at the court premises.
