Understanding child labour laws in Goa

In the absence of a child labour vigilance officer as required by law, Goa is witnessing growing incidences of child labour

Definition:   Theemployment of children in any work below the age of 14 is prohibited in thestate of Goa. 

Child labour includes:

All forms of hazardous employment as defined in theChild Labour Prohibition and Regulation Act 1986.

All forms of non-hazardous employment as defined inthe Child Labour Prohibition Act and Goa Daman and Diu Shops and establishmentsRules 1975.

All forms of domestic employment meaning employment inhouseholds, doing work of a domestic nature, other temporarily, permanentlypiece rated or part time job.

All forms of employment meaning labour such as ragpicking, plastic bag selling, running errands, carrying load of shoppers etc.

Rehabilitation after identification/rescue: Children who havebeen identified as child labourers shall be freed immediately from theirworkplace and placed in a regular children’s home or in a state run institutionor any other place identified under the plan of action. The state shall ensurethat a satisfactory rehabilitation programme is in position before takingaction on this.

Punishment:

Hazardous employment: A fine of Rs 50,000, withimprisonment of one year for the employer

Non-hazardous employment: A fine of Rs 25,000, withimprisonment of 3 months for the employer

All forms of domestic labour: A fine of Rs. 50,000 forthe employer
