A procedural issue relating to the proclamation proceedings against accused Surinder Kumar Khosla came up for hearing before the Mapusa court on Monday in connection with the fatal Birch by Romeo Lane fire case.
During the proceedings, the defence sought that the proclamation process initiated against Khosla be tagged with the chargesheet already filed in the case. The defence argued that the proclamation proceedings should form part of the same record being considered by the court.
The public prosecutor, while addressing the court, stated that a technical error had occurred during the issuance of the proclamation notice against the property owner. Owing to the error, the order inadvertently mentioned Khosla as absconding before the mandatory 30-day period prescribed under law had lapsed.
Following the submission, the court directed the State to file a reply explaining the circumstances surrounding the error. The matter has now been adjourned and will come up for hearing again on April 7.
