The State government on Tuesday issued a circular to regularize the houses constructed on the land allotted by the government as part of the 20-point programme while also reverting back the vacant plots. Under the programme, total of 5,179 plots have been allotted across the State.
A circular released by the Revenue Department stated that beneficiaries have been facing hurdles in obtaining No Objection Certificates (NOC) for repairs, renovations and bank loans, prompting the government to classify such plots into three categories with specific rules for regularisation.
Under the new policy, plots in Category A, where allottees have built houses and are residing with their families or legal heirs, will be converted from Class-II to Class-I by issuing a Sanad. This will be subject to the payment of a premium equivalent to 1/20th of the fair market value or minimum land rate as notified by the government.
Category B includes vacant and unused plots where allottees have not taken possession or constructed houses. These will be reverted to the government, with District Collectors empowered to take possession.
Category C covers cases where original allottees have unauthorisedly transferred possession to third parties who have since constructed and occupied houses. Such plots will be regularised on a one-time basis, with Sanads issued under Class-I occupancy, subject to payment of a premium of 1/20th of the fair market value and a penalty of an equivalent amount provided that such unauthorized possession of the plot has been obtained prior to February 28, 2014.
The circular further authorises both North and South Goa District Collectors to issue occupancy Sanads without referring individual cases to the cabinet, even if the land value exceeds Rs 50,000.
Once regularised, these grants will be governed by Section 37B of the Goa Land Revenue Code, 1968. Beneficiaries may also approach Deputy Collectors for regularisation of structures under the Goa Regularisation of Unauthorised Construction Act, 2016.
