Govt working to end TCP Act Secs 39A, 17(2): Dhavalikar

Minister says process will be gradual, not rushed

Amid growing concerns over land conversions and zone changes, Minister for Power Ramakrishna alias Sudin Dhavalikar on Tuesday said the government is making sustained efforts to gradually put an end to Sections 39A and 17(2) of the TCP Act, but stressed that the process cannot be rushed.

Responding to media queries, Dhavalikar said every government functions within the framework of existing laws and rules, which have been brought into force over a period of time. “Our government is aware of the concerns being raised and is working towards ending Sections 39A and 17(2). However, this cannot be done in haste as NOCs have already been granted to applicants under these provisions,” he said.

The minister added that any abrupt decision could lead to legal complications and affect applicants who have already received approvals. He assured that the government is examining the issue carefully to ensure a balanced approach that protects public interest while adhering to legal obligations.

Sections 39A and 17(2) of the TCP Act have been at the centre of public debate, with critics alleging that they facilitate land conversions and zone changes, impacting planned development and environmental sustainability. The government’s assurance comes amid increasing scrutiny and demands for reforms in the town planning framework.
