Balancing scales: New CJI to face key challenges

Justice Surya Kant’s swearing-in as the 53rd Chief Justice of India marks another landmark in the Indian judicial system. The new CJI is the focal point - not only for his leadership abilities but also for the fact that there are tough challenges awaiting, with subjects such as constitutional rights, civil liberties, and holding the governments accountable raging continuously. 

At present, the top court is bombarded with over a mammoth 90,000 pending cases, and the pile is growing, endangering the very concept of timely justice. The massive case load not only delays justice but also lowers the public trust in the judicial system, which in turn makes the problems of reform and efficiency very urgent and without any escape route. 

Justice Surya Kant is a great asset in terms of judicial experience, and he is also known for his integrity, independence of the judiciary, and fairness. Among others, he is recognised for his scrupulous and impartial rulings, having displayed a sharp grasp of constitutional and legal concepts. A review of his past decisions reveals that he is devoted to the causes of social justice, human rights, and the rule of law. These traits matter a lot while he is preparing himself to guide the court through cases packed with complexity and sensitivity, which, in most instances, have societal and political implications. 

Justice Kant is typically thought of as a judge who tries to resolve conflicts by subtle persuasion rather than by confrontation. His role during the farmers’ agitation is a testimony. When the situation was rapidly deteriorating due to the indefinite strike of farmers’ leaders at the Delhi borders, and the disorder was going to get out of hand, Justice Kant was the one who came to the rescue. He brought about the compromise not by imposing strict verdicts, but by urging both parties—the protesting farmers and the Union government—to talk it out. By facilitating dialogue between parties, Justice Kant showed not only his preference for consensus-building but also his practice and skill in handling this, which is an indispensable arsenal of a Chief Justice when confronted with complex societal issues. 

Among the main challenges Justice Kant could face are transparency in judicial appointments since he heads the Supreme Court Collegium, an area which has seen political meddling in recent years. He is expected to rejuvenate the collegium system, ensure appointments on the basis of merit, and promote diversity in the judiciary.

Secondly, the independence of the judiciary has come in for serious questioning with allegations of corruption tarnishing credibility and eroding public trust. Justice Kant will have to get into rebuilding people’s confidence and addressing accountability. Thirdly, he will have to face crucial cases on the Anti-Conversion Law, the law of appointing Election Commissioners, review petitions on the PMLA, besides the constitutionality of a section of the Bharatiya Nyay Sanhita and many other sensitive topics that may affect the country’s social fabric and democratic ethos. 

The road ahead for Justice Kant is not easy, but given his track record, there is an air of optimism. As the apex court grapples to keep pace with cases, his leadership will be vital in reaffirming the judiciary’s role as the custodian of justice and constitutional morality. The nation looks to him to lead with integrity, innovation, and unwavering commitment to justice.
