Jimmy Gazdar’s Aguada palace home sale hits legal hurdle after Kolkata firm obtains HC stay

The reported sale of the famed carved-from-a-mountain sprawling residence at Aguada of the late Jimmy Gazdar has hit a roadblock.

A Kolkata firm - Credwyn Holdings India Pvt Ltd - has moved court and successfully obtained a stay against any proceedings and legal formalities for the sale of the property from the Kolkata High Court.

A public notice issued by the lawyer for the firm Sanjay Ginodia said a suit had been filed in the Calcutta High Court back in 2016 for recovery of loans to the tune of Rs 3.29 crore from Gazdar.

The suit was ongoing when Gazdar died and media reports recently said the property is being bought by the GVR group from the late Parsi businessman's

 heir.

Ginodia in his public notice on behalf of his client Credwyn Holdings India Pvt Ltd said, that an application was moved before the Calcutta High Court after a report in the Kolkata edition of Economic Times on June 12 reported that Gazdar had died and that his property is in the process of being sold by his heir Rita Mehta.

"The Honourable High Court was pleased to pass an order dated 24th June, 2021, directing that inter-alia, that there shall be an order of restraint from sale, transfer, etc., of the said property," Ginodia's 'public notice' read.

It also said in case the sale has already gone through, the Calcutta High Court has directed that the heirs set aside Rs 6.26 crore in a separate fixed deposit.

The Calcutta High Court order will be in force for three weeks and the matter listed again on July 30, Ginodia's notice said.

Gazdar's Aguada property was a famed venue since the 1980s and hosted top-notch national and international public figures.
