Comunidade consultant, Advocate Andre Pereira, called the notice “illegal and contrary to law”.
He argued that the petitioners had acted in good faith in challenging what they believed was an unlawful decision.
“By serving this notice, the Comunidade has asked for its own funeral. The petitioners have only done their duty because an injustice was done. The notice is illegal,” Pereira said.
He cited Article 647 of the Code of Comunidades, which he claimed prohibits the granting of land to any entity in perpetuity.
“The High Court would not have dismissed the petition if the correct legal provisions had been properly argued,” he added.
Pereira also alleged that the lease of land to the private university was fundamentally flawed.
“Whatever has happened in Tivim – leasing of land to the private university – is a fraud. No government can approve such a grant of land,” he said.
