PWD principal chief engineer may get extension despite legal cloud

Even as the third service extension granted to Principal Chief Engineer (PWD) Uttam Parsekar comes to an end on January 30, sources indicate that the State government is considering retaining him in the post, possibly through an alternative route, despite multiple legal challenges pending before the High Court.

Highly placed sources in the Public Works Department said Parsekar remains the front runner for the post, with the government reluctant to disturb the existing administrative arrangement barely a year ahead of the Assembly elections.

“The thinking is to avoid upheaval at the top of the department at this stage,” a source said.

Parsekar’s continuation has, however, come under legal scrutiny. Separate petitions before the High Court have challenged not only his repeated extensions but also promotions within the PWD, alleging violations of recruitment rules.

Notices have already been issued to the government in these matters, adding to the uncertainty surrounding his tenure.

Despite this, there is strong buzz within the department that Parsekar’s perceived ability to maintain cordial working relations across political lines could weigh in his favour.

“He has a good equation with politicians cutting across party lines, and that counts in the present political climate,” an official said.

While a fourth formal extension may pose legal hurdles, officials suggest the government could explore appointing Parsekar on a short-term contractual basis.

“The government may avoid granting a fourth extension, but nothing prevents it from appointing him on contract for another six months,” a senior official said, speaking on condition of anonymity.

There is also speculation that the government could scrap the post of Principal Chief Engineer altogether, though officials admitted this was a remote possibility.

“The PCE does not have financial powers and mainly looks after administrative decisions,” a source pointed out, indicating that structural changes were unlikely.

The issue gains significance in light of a recent amendment to the Goa State Civil Services (Retirement) Rules, 2000.

Two months ago, the government introduced a proviso allowing officials in the PWD, Drinking Water, Water Resources and Electricity Departments holding the rank of Chief Engineer and above to continue up to 62 years of age – but only if no eligible candidate is available for promotion.

The amended rule further states that once an eligible candidate is promoted, the officer continuing beyond 60 years must retire immediately.

“A final decision will be taken after examining the legal position and administrative requirements. The government is conscious of the court proceedings as well as the need for stability in key departments,” a government official said.

Whether the government chooses continuity, a contractual workaround, or a policy shift remains to be seen, but the decision is expected before the end of the month, amid close legal and political watch.
