With Margao Municipal Council defaulting on payments to Fomento for treating daily garbage at the waste treatment plant as per the district Court order, Fomento has threatened to file a contempt petition before the Court at the hearing scheduled on January 28.
In fact, in a letter dashed to MMC Chief Officer Ajit Panchwadkar, Fomento pointed out that the Civic body has failed and neglected to pay an amount of Rs 25 lakhs despite repeated requests from the company.
In fact, Fomento told the MMC Chief Officer that failure to pay the sum constitutes contempt of the Court order, adding that the company will be filing appropriate application on January 28 seeking action against the CO as well as the municipal chairperson for contravening the Court order.
“As a last and final opportunity, we call upon you to forthwith pay the sum, failing which we shall be filing the application for contempt,” the company said.
Incidentally, Fomento has drawn the attention of the MMC to the fact that the company has raised an invoice dated January 21, 2020 for Rs five lakh.
This is the second time that the Civic body has delayed in effecting the payments to Fomento as per the district Court order. After the MMC had suo moto agreed to pay an amount of Rs one lakh to Fomento in lieu of the waste treated at the waste treatment plant, the district Court had issued directions to the MMC to pay the amount every week after receiving the invoice.
The affidavit filed by Fomento that the waste treatment plant is not in a position to accept any further waste as the plant is choked with excluded waste supplied by the Civic body is also expected to come up for
hearing before the district Court at the next date of hearing on January 28.
