The plea filed by the stall owners, who were recently evicted by the district authorities and saw their stalls dismantled, will be heard before a special bench of the Bombay High Court at Goa after Justice Mahesh Sonak recused from hearing the plea.
When the matter came up for hearing, Justice Sonak told the advocates for the petitioners that he had in the past as a lawyer represented the kiosk and stall owners who had installed themselves outside the Goa Medical College and Hospital and had filed several cases on their behalf and would hence ‘not be comfortable’ in now being a judge over the matter.
He, however, assured the petitioners that he would look into the matter to ensure that an alternate bench is constituted at the earliest so that the litigants are not inconvenienced.
