The bail application claims that he was forced to sign on blank papers which were then taken to be his confessional statement.
“The applicant was forced to append his signature and his thumb impression on many blank papers. The applicant refused at first but was promised that if he signs and puts his thumb impression on those blank papers he will be allowed to go home,” the bail application he has filed reads.
“He was assaulted and again threatened to be put in jail for ten years and hence the applicant appended his signature and put his thumb impression on various blank papers out of fear as he was promised for his release,” the bail application he has filed reads.
Kalangutkar was picked up by the respondents from Mapusa and then brought to Kerala by their vehicle. He has been booked in the FIR No. 36/2017 under section 20 B (a), 21(b) 22(c) of NDPS Act.
The bail application further states that he was not explained ground for his detention and arrest and that since he is a businessman having bar and restaurant in Goa and he also gives motorcycles and scooters on hire basis to tourists and hence receives many calls on his mobile phone from various people was brought to the office where he was asked various questions about him and his family and other such related questions.
The applicant answered all these questions and then the applicant was shown one person and asked to identify him. He was threatened by the officers of the respondent that he better cooperate with them or else he will be locked up for 10 years in jail.Kalangutkar, in his bail application has further claimed that the Supreme Court guidelines regarding rights of detained persons that have been laid down have been flouted with impunity.
“The officers do not have any jurisdiction to detain and arrest any person outside the local jurisdiction and hence the arrest of the applicant from Goa is bad in law and without jurisdiction,” the application reads.
“The applicant states that he was not produced before any magistrate in Goa before he was brought to Kerala and neither was he produced before any magistrate in Kerala within 24 hours of his detention and arrest he is in custody of the respondent officers from April 29,” it reads.
As a further condition for his bail he has said that he is “willing to cooperate with investigations and ready
to stand trial to vindicate his innocence.”
