The High Court of Bombay at Goa has granted permission for sharing contact details (phone numbers) from the mobile phone of Suchana Seth, who is facing trial for the alleged murder of her four-year-old son at Candolim this January.
The Court has however declined to allow the release of the mobile phone itself to the accused. Seth had challenged the Children’s Court order dismissing her plea for the return of the device.
The Bench of Justice Bharat Deshpande on Wednesday directed completing the procedure on November 21 in the presence of the Children's Court official.
"...The Children's Court could be requested to allow the Investigating Officer to copy the contact details available in the mobile phone of the petitioner (Seth), which is now deposited with the Court. Such procedure shall be carried out in presence of Superintendent or the Head Clerk of the said Court and a report to that effect shall be placed before the Children’s Court,” reads the order.
Stating that these details are to be used by the petitioner to contact her relatives as and when permitted by the Court, the Bench directed the devise be deposited back to Children’s Court after recording the details. Seth is currently serving judicial custody. The Children’s Court recently framed charges against her for trial.
