The Bombay High Court at Goa has directed trial courts to issue notices to those who furnished sureties for bail for notorious history-sheeter Tarzan Parsekar, who has absconded since his bail was cancelled in a pending criminal case.
“Courts where matters are pending are directed to issue notice to the sureties so as to find out Tarzan or his address. Besides fresh notice be issued to Tarzan through the Investigating Officer in the present matter. Report regarding notices to the sureties shall be furnished to this Court within a week,” reads the order by Bench Justice Bharat Deshpande.
The Court also directed the concerned four trial Courts to direct the Investigating Officer to immediately serve the sureties since in all these matters, Tarzan is one of the accused on bail.
The Bench was hearing a suo motu criminal revision based on the Supreme Court’s order on May 15, 2024, in a Special Leave Petition (Criminal) wherein it requested the High Court to suo motu examine the legality and propriety of an anticipatory bail granted to Parsekar by the Children’s Court, even after some material facts were noted.
The Bench observed that while an application for cancellation of bail in a 2022 offense against Parsekar was pending before this Court, he filed for anticipatory bail in another case before the Children’s Court.
The investigating agency informed the Children’s Court that the bail cancellation application was pending and that Parsekar had violated conditions imposed during his earlier bail.
Despite these facts, the Children’s Court granted bail, prompting the Apex Court to direct the High Court to examine the legality and propriety of the order suo motu.
