All eyes are focused on the Crime branch as the anticipatory bail applications of Leader of the Opposition Babu Kavlekar and his brother Babal in connection with the gambling case will come up for hearing before the South Goa Sessions Court on Wednesday morning.
The crime branch, which has sought custodial interrogation of the two brothers in the matka gambling case, were literally caught on the wrong foot on the last two occasions after the agency sought time to file reply to the bail applications and then on the second occasion, the investigating officer reaching late in the court with the reply and the case papers, prompting Sessions Judge B P Deshpande to adjourn the matter.
Previously, Public Prosecutor Ladislav Fernades was scheduled to argue on behalf of the state, but had literally expressed his inability to advance his arguments in the absence of the IO and for want of the case papers.
In separate but common reply filed in the bail applications, the Crime branch has sought custodial interrogation of the two brothers on the plea that the duo have not been cooperating with the investigating agency. The agency also charged the two brothers for misguiding the officers. In the reply, the Crime branch has stated that while Babu has claimed that the premises where the gaming article was found, belonged to Babal, the later in turn had denied that the articles belonged to him.
The investigating agency had sought the custodial interrogation of the two brothers since the case is being monitored by the High Court.
The crime branch had claimed that gaming articles, including slips having written numbers (carbon
copies) around 9000, calculators, note books and diaries were found in the close residential premises belonging to Babal.
Babal's lawyer, Adv Rajiv Gomes had rejected the Crime branch claim, saying the gaming material were planted into the premises since the locks and the keys were never sealed by the ACB during the raid on Babu's house earlier last month.
