The Additional Sessions Court in Mapusa has denied anticipatory bail to Gaurav Luthra and Saurabh Luthra in connection with a no-objection certificate (NOC) forgery case linked to an excise licence.

Speaking to the media today, Adv Parag Rao, representing the brothers, said, “The court has passed an order denying anticipatory bail. We are yet to receive a copy of the order and will decide on the future course of action thereafter.”

The anticipatory bail plea was rejected in a second case filed against the accused, in which they are alleged to have submitted forged documents while applying for permission to operate the Birch by Romeo Lane nightclub.

The case is linked to a tragic fire incident at the nightclub in Arpora on the intervening night of December 6 and 7, which claimed 25 lives.

An FIR registered on December 7 invokes Sections 105 (culpable homicide not amounting to murder), 125(a) and (b) (endangering life and personal safety), and 287 (negligent conduct with fire or combustible matter) of the Bharatiya Nyaya Sanhita.

A separate FIR was also been filed against the Luthra brothers and Ajay Gupta, alleging cheating and forgery for fabricating documents as part of the licence application process.
