A man convicted of attempted murder and destruction of evidence has been spared from serving an additional period in jail after the Sessions Court, North Goa set off his 26-day sentence already undergone after his arrest in the case dating back to 2015.
The accused Amardeep alias Amar Mandrekar, from Korgao-Pernem, was charged with assaulting Sachidanand Narse with a sickle on February 16, 2015, causing bleeding injuries. The prosecution submitted documentary evidence including a hurt certificate, medico-legal report and other medical records, which proved the injuries sustained by the victim.
The order pronounced by Sessions Judge Irshad Agha stated the intention to commit murder could be inferred from the nature of the weapon used, a sickle; the severity and place where the injuries are caused.
The Court noted the accused could inflict such a blow being armed with a dangerous weapon. He was thus convicted and sentenced to 26 days of simple imprisonment for the offense under Section 307 of the Indian Penal Code for attempted murder and Section 201 IPC for destruction of evidence.
Since the accused had already undergone this period, the Court set off the sentence.
“Records show that the accused was in custody for a period of 26 days. The accused is the first offender. The accused is also of very young age and in case the accused is sent to custody his further life may be ruined. Instead of sentencing him in imprisonment, appropriate compensation could be directed to be paid by the accused to the victim,” it observed.
The accused is also directed to pay Rs 5,000 as compensation for each offense. “Both the sentences shall run concurrently. In default of payment of total compensation amount of Rs 10,000, the accused shall undergo simple imprisonment for a period of 10 days. In case the amount of Rs 10,000 is deposited, the same shall be paid to the victim Sachidanand Narse. The period of custody of 26 days already undergone by the accused is considered and sentence awarded today is set off,” the Court ruled.
