The chargesheet filed by the Fatorda police in the Mungul gang war case has stated that the accused persons had hatched a ‘pre-arranged plan’ to assault one Walter Fernandes in the wee hours of August 12 last.
In the 624-page chargesheet, the Police said that in furtherance to the pre-arranged plan to assault Walter, the accused formed an unlawful assembly and armed themselves with deadly weapons -- filled soda bottles, iron rods, hammers, choppers, swords, knives, axe and a firearm.
Believing that Walter Fernandes was travelling in the Baleno car owned by the complainant, Yuvkesh Singh Badaila, the accused persons A-1 to A-25 wrongfully restrained the vehicle in front of Bab Bakery, near Sagun Restaurant, Mungul, Fatorda, Salcete, Goa, using white Toyota Innova, a white Maruti Suzuki Fronx and a red Maruti Suzuki XL6.
The chargesheet further stated that accused persons A-1 to A-26 brutally assaulted the complainant and his friend with the weapons, thereby voluntarily causing grievous hurt by dangerous weapons resulting in sharp cut injuries to both victims and damaging the complainant’s car.
Further, accused (A-27) Amog Naik allegedly fired two bullets from his pistol aiming at the complainant with intention to kill him, which one bullet struck the left side door of the complainant’s Baleno car. After the attack all the accused persons fled the scene in their respective vehicles, the chargesheet stated.
It further stated that accused (A-10) Joyston Fernandes allegedly arranged a Baleno car for the other accused persons (A-11) Avinash Gunjikar, (A-12) Imran Bepari, (A-13) Akshay Talwar and (A-17) Mohammad Tahir Khan to flee from Goa after the commission of the crime, inspite of knowing that they being allegedly involved in the crime, thereby allegedly facilitating their escape from police.
The chargesheet stated that accused Deepak Kattimani (A-14) & Parshuram Rathod (A-15), knowing that the accused were involved in the crime, allegedly helped the Accused (A-10) Joyston Fernandes, (A-11) Avinash Gunjikar, (A-12) Imran Bepari, (A-13) Akshay Talwar and (A-17) Mohammad Tahir Khan to stay in a hotel in Karnataka, thereby facilitating their escape and harbouring them.
The chargesheet further charged accused (A-26) Vally D’Costa, (A-27) Amog Naik & (A-28) Prakash Karbar for allegedly destroying their mobile phones and failing to produce the same during investigation.
“Thus, the accused persons A-1 to A-28 committed offences punishable Under Section 109, 111, 115(2), 118(1), 118(2), 126(2), 324(4), 351(3), 61(2), 241, 249(B) r/w 190 of Bharatiya Nyaya Sanhita, 2023 and Sections 3, 4 r/w 25 of the Arms Act, 1959
