The previous line of argument centered on ‘duty of care’ leveled against Samson appeared to have
been abandoned by the prosecution.
“A defenceless child of tender age has lost her life,” Special Public Prosecutor for Central Bureau of Investigation Ejaz Khan submitted before the Court while seeking conviction for the two accused for culpable homicide not amounting to murder among other charges with the maximum punishment of life imprisonment.
The statement of Murali Bolloju, who was present at Luis Shack when Scarlett entered the shack a few hours before her death, was highlighted.
Murali had stated that he saw Samson grab Scarlett from behind after she ran behind the shack in inebriated state. Samson asked him to look for Scarlett’s sandal and when he could not, Samson told him two to three times to leave.
“Why was Samson holding Scarlett from behind? It does not show consent,” the CBI counsel questioned, drawing the Court’s attention to Samson’s actions.
Refuting allegations of a tardy investigation leveled by the defence, Khan also stated before the Court that there were no lapses in Goa Police and CBI investigations.
