Five shack operators have filed a writ petition raising objection to the experienced category and seeking drawing of lots irrespective of the total number of years of experience in the business. The petition is likely to be heard for admission next week.
The petition comes four days after the government notified the policy wherein 10 percent are reserved for inexperienced operators, another 10 percent for those with 1-4 years of experience, and the remaining 80 percent for operators with an experience of 5 years or more.
The Tourism Department also simultaneously invited applications for the allotment of the temporary structures with the last date being October 27 while the allotment date is scheduled on November 3.
The petitioners have prayed that the government promptly revoke Clause 9 of the policy, along with its explanation regarding experience criteria for allowing the setting up of temporary shacks on the coastline.
They argue that this clause violates Articles 14, 19 (1) (G), and 21 of the Indian Constitution, and hence sought an injunction against the Tourism Department from selecting applicants or allottees based on their experience.
“A random draw should be conducted, treating all applicants equally regardless of their years of experience,” it further said seeking the High Court’s intervention in the allotment process.
The shack allotments have already been delayed while the State is in the midst of tourism season and footfalls increasing as the peak season approaches.
