The Goa Coastal Zone Management Authority has issued a show cause notice to the proprietors of popular beach club Tito’s and Mambo’s located along the Baga beach at Calangute for alleged violations of CRZ following a complaint by Kashinath Shetye as well as from the inspection report filed by the expert members of the GCZMA.
In his complaint, Shetye alleged the illegal construction of structures beyond what was permitted and that the structures are being used for commercial purposes in the form of the Tito’s and Mambo’s clubs in violation of the CRZ notification in force.
In its notice to the proprietors, the GCZMA member secretary Ravi Jha has said that the structures “appeared to be without prior approval of the GCZMA as required under CRZ 2011.”
He referred to the inspection report filed by Audhoot Bhonsle and Prabhakar Shirodkar said that the legality of the structures “is not known yet… so their legality needs to be established” since as per the survey plans the only authorized structure existing at site pertains to the 1972-75 period.
As per the CRZ regulation, no new constructions are permitted within the No Development Zone and only
reconstruction is permitted on the plinth of the old structure existing prior to 1991, with no change in the plinth area with proper permission from the GCZMA.
Adv B Sardesai who was representing the management and present at the time of the inspection of Tito’s offered no documents to show that the new structures existing at the site were legal structures, constructed with proper permissions from the Authority.
The owners have now been directed to reply to the notice and produce approvals along with the approved plans in order to avoid proceeding against them as per CRZ law.
This is not the first time Tito’s is facing violations of CRZ with a complaint being filed in 2009 by one Ravindra Jana but was given a clean chit by the High Court.
