The Bombay High Court at Goa on Monday deferred acting against Shrem Resorts Pvt Ltd, who are facing charges of deliberately filing a false affidavit before the High Court instead offering the violators a chance to file a detailed affidavit before the Court.
Shrem Resorts Pvt Ltd face charges of deliberately misleading the Court by falsifying an affidavit to state that no commercial activities were being conducted in a property located in Candolim village.
In their affidavit, they told the court that a live music event which is promoted by ‘Toy Beach Club, Goa is scheduled to be held from 09.12.2021 to 11.12.2021 at an open air venue situated at Vagator, Bardez-Goa, and not in the property, which is the subject matter of the present petition.”
However, petitioner Roshan Mathias tendered photographs of the event, which is to take place from 09.12.2021 to 11.12.2021 at the aforesaid place, to prove that the event was in fact going to take place at the Candolim property and not in Vagator contrary to what was told to the Court.
The photographs submitted by Mathias showed that Toy Beach Club has advertised an event which is to take place on 11.12.2021. The photographs also reveal the construction, which is happening at the moment at the said spot.
In their response filed before the Court on Monday, Shrem Resorts told the court that “the decision to change the venue to Vagator was taken at the last minute and, hence, equipment was found at the property which could not be shifted.”
“Prima facie, we are not convinced with the explanation offered by the respondent no. 6 in the said additional affidavit tendered today. However, it will be appropriate to wait for the report/ affidavit-in-reply on behalf of the respondent nos. 1 & 4,” the High Court said.
The GCZMA had in 2019 ordered demolition of the illegal structure and had ordered that no commercial activity would take place in the said plot.
