Citing recent incidents, including the attack on a female advocate’s vehicle during an inspection, the South Goa Advocates Association (SGAA) made a strong pitch for the Advocates Protection Act in Goa on the lines of Rajasthan and Karnataka.

Law Minister Aleixo Sequeira, however, did not make any commitment to the lawyers after receiving their memorandum but asserted that the government would walk the extra mile if it is possible that such a law is required after a study.

The SGAA said the legislation will provide legal protection against threats and violence and safeguard advocates from intimidation, assault, and malicious prosecution arising from their professional duties.

The association said the law would set up mechanisms to address harassment and threats by establishing clear, efficient channels to address undue harassment and threats that impede advocates from fulfilling their responsibilities, and will reinforce advocates' independence and safety by promoting trust in the legal system by ensuring the independence and safety of advocates, who are crucial in the administration of justice.

“Such an Act will not only safeguard the legal profession but also strengthen the rule of law and uphold public confidence in our justice system,” the memorandum said.

“Recent incidents, including the attack on a lady advocate's vehicle during an inspection and the registration of an FIR against her based on a counter-complaint, illustrate the pressing need for immediate legal safeguards to protect advocates in our state. Such incidents undermine the dignity and security of legal practitioners, making it imperative for the state government to take decisive action,” SGAA president Adv Prasad Naik said.

He added: “Advocates, as officers of the court, play a crucial role in the administration of justice. It is, therefore, vital to ensure their safety and independence while performing their duties. Recognising this necessity, the state governments of Rajasthan and Karnataka have already enacted the Advocates Protection Act to safeguard legal professionals from harassment, false complaints, and threats.”
