Court sets aside eviction order of 5 shopkeepers from CCP market building

PANAJI

The North Goa Principal District Court has set aside the eviction order issued against five shopkeepers occupying premises in the Corporation of the City of Panaji (CCP) market building, holding that the action violated the principles of natural justice.

In its order, the court remanded the matter to the Estate Officer for fresh consideration and a reasoned decision.

The eviction proceedings were initiated after the CCP classified the shopkeepers as unauthorized occupants, stating that their lease, which was last renewed on July 1, 1999 had expired on June 30, 2002, with no subsequent renewal. 

The action was taken under the provisions of the Goa Public Premises (Eviction of Unauthorized Occupants) Act.
