FSL’s failure to submit analysis of seized drugs results in bail to Nigerian

The State Forensic Science Laboratory’s (FSL) failure to provide an analysis report of the drugs seized from Nigerian national Chinedu Monday Nwafor has resulted in his bail, five years after his arrest in 2019.

Despite numerous reminders to the FSL over the past three years, the analysis is yet to be complete. Interestingly, all this is despite a charge sheet filed two years after registering the FIR.

Nwafor was arrested by the Calangute police for allegedly possessing commercial quantities of Charas, Cocaine, MDMA, Ecstasy, and LSD during a raid in the coastal stretch.

He has been in custody at Colvale Central Jail since then, with three previous bail applications being rejected.

In his order on Monday, Special Judge, NDPS-2 (Mapusa) Bosco Roberts noted that this is the fourth bail application filed by the accused because the Chemical Analyser’s Report for testing LSD and Ecstasy has not been received for the past three years after filing the chargesheet.

Previous bail applications were rejected in February 2020, November 2020, and October 2022, and those orders were never challenged.
