Enforce SC guidelines on construction licences immediately: HC to govt

The High Court of Bombay at Goa on Monday directed all concerned authorities to immediately implement the guidelines issued by the Supreme Court on construction permissions and related matters.

Disposing of Public Interest Litigation Writ Petition filed by Agnelo Baretto, the Division Bench of Justice Suman Shyam and Justice Amit Jamsandekar ordered that the directions of the apex court, along with subsequent circulars issued by State authorities, be enforced “in letter and spirit”.

The petitioner, represented by Advocate Sahil Sardesai, during the hearing submitted that despite circulars issued by the Directorate of Panchayats, the Department of Urban Development and the Chief Town Planner in 2025 and January 2026 for implementation of the Supreme Court’s judgment dated December 17, 2024, no effective steps had been taken by the authorities.

Adv Sardesai then urged the court to direct immediate implementation of the circulars. Additional Government Advocate Akshata Bhat, representing the respondents, stated that the State had no objection if such a direction was issued.

After perusing the apex court judgment and the three circulars, the Bench observed that the relief sought could be granted.

“We, therefore, dispose of the Writ Petition by providing that all concerned Authorities shall take immediate steps for implementing the judgment and order dated 17.12.2024 as well as the three Circulars dated 09.05.2025, 14.01.2026 and 14.01.2026 respectively in letter and spirit,” the court said while disposing of the petition. 

The court further directed that a copy of the order be circulated to all concerned departments to ensure compliance with the guidelines issued by the Supreme Court.
