In a letter published on IATG on December 1, Jaiwant SureshKamat had complained about harassment and the flouting of various rules by theoperators of City Lodge, located in Komba Vadda, PDA Colony in Porvorim, it wasfound that there exists certain violations by the hotelier in terms ofencroachments over the compound wall where the hotelier was seen operating hiskitchen as well as the reception counter of lodge.
According to the complainant the hotelier had accommodatedhis staff workers on terrace, he had also complaint of contamination of thesurrounding area by discharge of dirty water from the septic tank and garbageof the restaurant in the open plot adjoining in the lodge; which furtherresulted in breeding of mosquitoes and a foul smell.
When The Goan visited the site, it was noticed that theterrace was covered with temporary shed allegedly to accommodate the workers,however the overflow of septic water and garbage menace in adjoining plots wasnot seen.
With regards to the TCP rules ‘allegedly’ flouted by thehotelier as he was carrying out commercial activities in an area earmarked forresidential purposes, it was found that the hotelier has permission from thelocal Pilerne “ Mara Panchayat, such as approved occupancy certificate dated11-5-2004, NOC for restaurant cum cyber café dated 10-11-2006, and NOC tostart/ open paying guest accommodation/ guest house dated 16-12-2004. It wasalso found that the hotelier Pandurang Kamat has permanently covered the full setbackarea and using to accommodate restaurant, kitchen, and rooms which is in gross violation section 4.5 of The Goa(Regulation of Land Development and Building Construction) Act, 2008, The Goaland Development and Building Construction Regulation, 2010.
According the Santosh Kamat, who is managing the restaurant,say “I agree that the area inside my property has been used as a temporaryshed, but I’m not the only one who has done that. Almost all the buildings inthe row have carried out extension due to a lack of space. I have not doneanything illegal.”
