The High Court of Bombay at Goa on Thursday disposed of a writ petition about illegal constructions in Chicolna, Bogmalo, after the Administrator of Comunidades (South Goa) assured the court that structures already served notices would be removed.
The petition, filed last year by the Forum Against Corruption, Illegalities and Destruction along with two others, objected to illegal RCC construction in property bearing Survey No. 4/1 of Chicolna, Bogmalo, which belongs to the Comunidade of Chicolna. The petitioners claimed they were aggrieved by the inaction of the Administrator of Comunidades in implementing directions issued by the Collector.
During the final hearing, the counsel representing the Administrator of Comunidades and the Collector (South Goa)/DCA, South Goa submitted about notice issued to several individuals under Article 371(2) read with Article 372 of the Code of Comunidade.
The notice directed the occupants to vacate the land immediately upon receipt and warned that if the structures were not removed within the given time, they would be demolished at the respective occupants’ cost.
The counsel assured the Division Bench of Justice Bharati Dangre and Justice Nivedita Mehta that the notice issued by the Administrator of Comunidades, South Goa, Margao, would be enforced within eight weeks. With this assurance, the court observed that the petition had served its purpose and disposed of the matter.
