The National Green Tribunal Principal Bench in New Delhi has dismissed a set of 19 appeals filed against 121 illegal structures built in the no development zone of Baina beach.
In an order passed on Friday, the National Green Tribunal Principal Bench of Justices Adarsh Kumar Goel, Raghuvendra Rathore, Satyawan Singh Garbyal and Nagin Nanda declined to interfere in the orders for demolition of the structures.
On conducting a survey of the area with respect to the structures at the Baina Beach, a report was submitted before the GCZMA that 121 structures have been raised in violation of CRZ norms. Accordingly, the affected parties were notified and were required to show cause why the illegal structures be not directed to be demolished.
The appeals filed by Sushilawa Harijan and others, said there was no identification of structures and house numbers had been allotted in respect of structures.
The GCZMA, after due consideration, rejected the stand of the appellants.
“The constructions had been raised without any NOC or permission from the competent authority. Once there was no permission, even if the structures were prior to 1991, the same are unauthorized and illegal,” the GCZMA had ruled.
“We find that the authorities have given valid reasons for declining the permission to regularize. The area is admittedly eco-fragile and is under stress due to illegal and unauthorized constructions and the area is ‘no construction zone’. In view of the above, we do not find any ground to interfere with the impugned orders. The appeals are dismissed,” the NGT ruled.
