Old Goa Police had registered the case on November 9, 2014, upon receiving a complaint from the victim’s mother, which said that the offence occurred on the previous day.
On the same day, Shaikh was arrested by the Old Goa Police under Section 354 D and 506 (ii) IPC, Section 8 (2) of Goa Children’s Act, 2003 and Section 12 of Protection of Children from Sexual Offences (POCSO) Act.
Subsequently, after conducting a medical examination of the minor girl at Goa Medical College, Bambolim, and her statement, Section 376 of IPC and Section 4 and 8 of POCSO Act were added to the charges.
Shaikh, who was 21 at the time of arrest, was remanded to eight days police custody on arrest and has been in judicial lock-up since then at Sada sub-jail, Vasco.
The complaint had alleged that Shaikh outraged the modesty of the minor girl and threatened her with dire consequences if she narrated the incident to her mother.
President of Children’s Court Vandana Tendulkar, in her order, has asked Shaikh to execute a bail bond with surety in amount of Rs 10,000 under Section 437-A of CrPC while laying down that the bail will be in force for six months. PSI Sagun Sawant investigated the case and chargesheeted Shaikh under the sections laid down at the time of arrest.
Public Prosecutor K Sanzgiry and Adv M Menezes argued the case in Children’s Court. Interestingly, while the prosecution examined 11 witnesses in support of its case, no evidence was led in defence by the accused..
