The legal counsel of Corvus Urban Infrastructures LLP has objected to the intervention pleas of the three parties who had sought to intervene in the Old Goa structure issue case in the court of the Additional Director of Panchayats (ADP).Speaking to the media, ADP Umakant Korkankar said the appellant has filed his reply to the three intervention pleas.
“Naturally, he will say that they should not be allowed in the proceedings and their applications be dismissed. However, this court has fixed the matter for arguments on June 15 wherein the three intervenors will file their say. After that, this court will decide whether the three intervenors are to be allowed to intervene or not,” Korkankar stated.
He also said till the next hearing, the status quo is extended.
“It will take some time as intervenors will file arguments after which the appellant could also file counter arguments. After hearing all sides, it will then be decided whether to allow the intervenors or not. Only after that will the main case start,” he added.
It may be recalled that three intervenors have filed intervention pleas in the matter which include Save Old Goa Action Committee, Golda and others, and Adv Amit Palekar.
Adv Palekar dismayed over delay, ADP says cannot just rush
OLD GOA: One of the intervenors Adv Amit Palekar has expressed dismay that the matter of the Old Goa structure issue is taking too long and has demanded that the proceedings be expedited so that the structure is demolished at the earliest.
Speaking to reporters, Adv Palekar said, “Since the licences to the structure have been revoked, it is deemed illegal and should be demolished. But there is unnecessary delay in the process to decide the appeal which is not fair.”
“If the government has intentions to take action against the structure expeditiously then the matter should be disposed off and demolition of the structure ordered,” Palekar demanded.
However, Additional Director of Panchayats Umakant Korkankar said the matter has to be heard and decided as per the civil procedure code.
“We cannot just rush through the process,” he added.
When pointed out that questions have been raised over the delay in demolishing the structure even when the licences have been revoked, Korkankar said the court has to know who is right and who is wrong.
“The matter is only at the pleading stage where the parties are submitting their documents. After deciding on the intervention applications, the main case will come up, which will be decided on merit,” he added.
