Arguments on the application filed by the prosecution to recall the rape victim girl for examination in the minor girl rape case allegedly involving Revenue Minister Atanasio Monserrate will be heard in the South Goa sessions Court on September 8.
When the matter came up before Special Judge Irshad Agha, the defense raised objections to the application filed by the Public Prosecutor V G Costa, who had filed a plea before the Court for the recall of the victim girl for her reexamination.
After going through the reply from the defense and the application filed by the prosecution, Judge Agha adjourned the matter for arguments on September 8.
At the last date of hearing, the prosecution representing the government has filed an application before the South Goa Sessions Court, Special Judge Irsha Agha for the recall of the victim girl for her re-examination.
Public Prosecutor V G Costa moved the application under section 311 of the Code of Criminal Procedure and under section 154 of the Indian Evidence Act when the case came up for hearing before Judge Agha on Monday.
Cross-examination of the minor victim girl was completed on August 23 last after the victim was cross examined by Mumbai-based celebrity defense counsel, Adv Pasbola, representing Revenue Minister Atanasio Monserrate.
