Hate speech: Vasco JMFC reserves bail order of Madhav Khattar

The Vasco Judicial Magistrate First Class (JMFC) has reserved the bail order of Madhav Khattar, brother of hate speech accused Gautam Khattar, after arguments concluded in the matter today. 

The decision is expected either by 5 pm today or by 10 am tomorrow.

During the bail hearing, advocate Amey Prabhudessai, appearing for the 18-year-old, denied all allegations stating that investigation found no role of Madhav in preparing the controversial speech on St Francis Xavier. 

Instead, he alleged the speech was written by Gautam himself. "Madhav had no role in the matter. All allegations against him are untrue,” the adv said.

He also claimed that Madhav's arrest had bypassed legal procedure explaining that in offences punishable below seven years, a mandatory notice under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita (earlier Section 41A CrPC) should have been issued before arrest. The advocate added that the arrest in such circumstances was unnecessary and unjustified.
