PANAJI: The Bombay High Court at Goa on Monday granted bail to Hayden Cipriano Fernandes, who is accused of stabbing another young man Alistair Pulical causing him simple injuries.
In its judgement, the High Court bench of Justice B P Deshpande took cognizance of the fact that the chargesheet is already filed, that the injuries are simple in nature and that there are multiple complaints and cross complaints against the accused and the victim, who is himself now absconding in one of the complaints filed against him.
“Chargesheet is already filed and there is another complaint filed against the victim by a friend of the father of the accused, it is reported that the victim is not traced and he is absconding. Be that as it may, the fact remains that there are multiple complaints and cross-complaints against each other, however since the investigation is complete and injuries found on the victim are simple in nature, prima facie could be considered at this stage and for bail that the offence is merely covered under Section 326 of IPC,” the High Court ruled.
The incident took place somewhere on 13.5.2024 at 6.45 p.m. in which the victim alleged that the accused suddenly came and blocked his way and then assaulted him with a knife on his head, and shoulder. However, he managed to escape from the spot.
Fernandes approached the High Court after his bail application was rejected by the Sessions Court. The prosecution argued that earlier incidents between the parties would go to show that there is enmity between the parties and if the applicant is released, there is every possibility of commission of any further offence.
The prosecution also pointed to the use of a knife in the attack.
The High Court allowed the applicant to be released on bail on furnishing a personal bond of Rs.20,000/- with one solvent surety in the like amount to the satisfaction of the learned Sessions Judge Mapusa and on the condition that the applicant shall not enter the area of Colvale Police Station without prior permission of the learned Sessions Court among other conditions.
