"We require the salvage agents to issue a fresh certification of the vessel's condition and to state specifically that there is no risk of the vessel sinking or capsizing either at Verem anchorage or while it is being moved to Jaigad... the certificate from the salvagers must specifically state that the vessel is fit for movement from its present location to Verem anchorage and that there is no risk of the vessel sinking or capsizing at that anchorage. This must be given before it is moved to that anchorage," the HC said.
The owners told the HC that after underwater survey, and such repairs as are essential which is to be done at a location in Verem, the vessel will be then towed to the Port at Jaigadh where there is a dry dock for all other repairs. They informed the court that tides are presently too low to allow for vessel to be towed any greater distance.
