High Court quashes Vasco magistrate order, says lacks application of mind

The High Court of Bombay at Goa has quashed a Vasco Magistrate’s order in a food safety case, saying it showed no proper application of mind.

Justice Ashish Chavan set aside the March 28, 2022 order of the Judicial Magistrate First Class (JMFC), Vasco, which had issued proceedings against seven accused based on a complaint by the Directorate of Food and Drugs Administration.

The court was hearing two connected writ petitions filed by traders and individuals, including a Vasco shop owner and suppliers from Margao and Kolhapur.

The petitioners argued that the Magistrate’s order—“Cognisance taken. Issue summons”—was too brief and lacked reasoning.

Agreeing, the High Court said even at this stage, some indication of application of mind is required.

The matter has been remanded to the JMFC, Vasco, for fresh consideration.
