Anjuna police had charge sheeted the trio in a 2014 matter for offences of unlawful assembly, rioting armed with deadly weapon, wrongful restraint, attempt to murder and voluntarily causing hurt by dangerous weapons or means.
As per the complaint lodged by Kaustubh Ganguli, a group of nine people assaulted him and his six friends on December 2, 2014 with a wooden danda and knife whereby the victims sustained grievous injuries. The complainant and his friends were tourists from Delhi and are flying officers of the Air Force. He stated that his group was headed towards Chapora Fort on hired scooters in the morning on December 2, 2014 when at around 11.45 am, a motorcycle overtook one of them at Vagator.
After some time, however, the complainant saw the same motorcyclist returning. The motorcyclist then stopped and slapped the complainant’s friend on his face and then began assaulting him with a wooden danda. In the meantime, eight other persons joined the assailant and began assaulting the group of friends. One of the accused attempted to stab the complainant on his stomach with a knife but the complainant blocked the attack with his right hand thereby sustaining an injury. The victims then ran in different directions to prevent further attack.
Police carried out scene of offence panchanama and recovered the wooden danda from the spot but failed to recover the knife. However, the hurt certificate showed only simple injuries caused by blunt object and abrasions and the police failed to place on record the final medical report.
The complainant stated that he identified photos of the three accused shown to him at the police station before lodging the plaint. The court also noted that the police failed to prove the identity of the accused as the investigating officer showed pics of some persons to the victims instead of conducting an identification parade. Also, the panchanama was not recorded to prove that the police were in possession of the photos of the accused at the time. The police also did not attach records to show that the accused are habitual offenders.
