Goa Children's Court on Friday sentenced Rukmuddin Kudminchi, a native of Bagalkot, Karnataka, to undergo rigorous imprisonment for ten years while directing him to pay a fine of Rs 2 lakh for having sexual intercourse with a minor boy against the order of nature in 2011.
Children’s Court Judge Vandana Tendulkar, in the judgement, has stated that failure to pay the fine will attract simple imprisonment for two years.
The judge also ordered that the fine amount recovered shall be deposited in the name of the victim in a fixed deposit account in a nationalised bank till he attains majority.
Earlier on February 26, Children’s Court had convicted Kudminchi, who was 22 at the time of the incident, for offence under Sec 377 (carnal intercourse against the order of nature) of IPC read with Section 8(2) (grave sexual assault) of the Goa Children's Act.
The victim's father had lodged a complaint with the police on September 16, 2011.
Judge, while sentencing the convict, said that the age of the victim, who was aged 8.5 to 9.5 years at the time of incident, in this case at the time of offence was tender for being exposed to such a heinous crime.
Considering that Kudminchi was in judicial custody since the time of his arrest on September 16, 2011, for almost 4.5 years, the period of detention is set off against the term of substantial imprisonment imposed on him.
Children’s Court also sentenced Kudminchi to undergo rigorous imprisonment for seven years and imposed a fine of Rs 1,000 under Section 377 of IPC. These two terms are set to run concurrently.
Police Inspector of Bicholim police station Harish Madkaikar was the investigating officer in the case.
