Asserting that it was not practicable to entrust the task of planning to local Panchayats and municipalities, Chief Town Planner Rajesh Naik told the High Court that these bodies neither had the technical experts nor basic expertise and that, overall planning in the state would be impossible as every panchayat and municipality may have different plans. Collating and formulating these diverse and different plans would be an impossible exercise, he said in the court.
The Chief Town Planner was replying to a petition filed by the United Goans Foundation praying that Sections 10-17, 33-37 and 39 of the Goa Town & Country Planning Act, 1974 be declared unconstitutional. The petitioner had also prayed for a direction to ensure that all panchayats/corporations/councils prepare the development plans as required under Section 238 of the Goa Panchayat Raj Act, 1994 and Section 184F of the Goa Municipalities Act, 1968.
