MARGAO: The Administrative Tribunal has ordered the return of the Memorandum filed by Savio Coutinho in the BPS Club property case after holding that the revision application filed by him before the Tribunal against the order of the Inspector of settlement and Land Survey is non-maintainable.
In an order, Administrative Tribunal President Savio Correia said the applicant shall be at liberty to file an appropriate appeal before the Competent Authority in accordance with law.
Coutinho had instituted the proceedings before the Tribunal after the Inspector of Survey Land Records, Margao dismissed his application for intervention in the confirmation proceedings pertaining to the BPS Club.
The Respondents including BPS Club raised a preliminary objection to the maintainability of the present proceedings before this Tribunal on grounds that the Code provides a clear and mandatory hierarchy of appeals under Section 188, that an original order of the ISLR is appealable in the first instance to the Superintendent of Surveys and Land Records (SSLR). They further contended that the Administrative Tribunal acquires jurisdiction only as a second appellate authority.
In his order, Tribunal President Savio Correia held that the present proceedings initiated by Coutinho are non-maintainable. “The order of the ISLR is an original order appealable to the Superintendent of Surveys and Land Records. The Tribunal’s jurisdiction arises only as a second appellate forum”, Correia said.
At the same time, Corriea considered it appropriate not to dismiss the proceedings outrights, but to return the memorandum of the applicant so that the same may be presented before the competent authority.
