The native of Nepal Nima Tamang, who was held guilty by the South Goa Sessions Court for the murder of his co-worker, hailing from Himachal Pradesh, has been sentenced to undergo imprisonment for life and fine of Rs 50,000 and in default to undergo simple imprisonment of one year.
The accused is also sentenced under Section 394 of Indian Penal Code to undergo rigorous imprisonment of 5 years and fine of Rs 10,000 and in default to undergo simple imprisonment of six months.
The accused had on February 12, 2019 around 02.30 hrs, assaulted 33-year old waiter Ranjeet, a native of Palampur, Himachal Pradesh with a wooden rib on his head and face and committed murder. He later decamped with cash and mobile from the possession of the victim waiter, Ranjeet Singh, thereby committing an offence punishable under Section 302 and 394 of Indian Penal Code.
In his order, Additional Sessions Judge Vincent D’Silva observed that the prosecution has proved all the circumstances that the death is homicidal death; scene of occurrence panchanama; abscondence of the accused after committing crime; arrest of the accused; recovery of cash; two mobiles from possession of the accused; blood stained clothes of the accused having the blood of the deceased so also on his person; (motive to commit crime; besides statement of the accused under Section 313 of Code of Criminal Procedure.
“Pertinently, the murder that took place involving the deceased Ranjeet was in the same transaction where the cash of Rs 11,310 as well as the mobile of the deceased were found missing from the deceased. Therefore, the stolen articles which were found in the possession of the accused were belonging to the deceased and therefore, the inference which could be drawn in the present case is that the accused was guilty of voluntary causing hurt/murder in committing the robbery and therefore, the above offence is proved against the accused,” Judge Vincent observed.
