The Bombay High Court at Goa has granted bail to one Asif Khwaja who was convicted of sexually assaulting a girl by the trial court and sentenced to ten years rigorous imprisonment.
Khwaja told the court that he was on bail during the trial and was arrested after his conviction in order to serve the sentence. Khwaja also told the court he has “a good case on merits and that [he] and prosecutrix were in relationship for a period of eight years and only because the applicant failed to marry the prosecutrix as allegedly promised, she filed an FIR.”
“Since applicant was on bail during the trial and there are no allegations of flouting the conditions of bail during the trial, the applicant could be enlarged on bail as there are prima facie good grounds on merit,” Justice Bharat Deshpande ruled.
