The Supreme Court has refused to give temporary relief to a private firm against the Bombay High Court’s Goa bench ruling that quashed the Outline Development Plans (ODPs) for five coastal villages in North Goa.
On 22 July, the apex court rejected requests from the State government and the Town and Country Planning Department to stay the High Court judgment. Instead, it ordered that the current situation should continue unchanged.
In its latest order on 18 August, on a petition by Devashri Nirman LLP, the Supreme Court confirmed that the status quo will continue. The court also issued notice and scheduled the final hearing for 16 September.
The company had sought a stay on the High Court’s 23 June ruling or, alternatively, a direction to prevent any coercive action against its three projects.
“The three projects have come to a halt due to the High Court ruling and the Supreme Court’s status quo order,” an NGO said.
Devashri has three ongoing residential projects in Candolim and Arpora, with a total of 337 flats: ‘Florenza’ in Arpora (195 units), ‘Vista Bonita’ in Candolim (54 units), and ‘La Stella’ in Candolim (88 units).
The High Court had quashed the ODPs of Candolim, Calangute, Arpora, Nagoa and Parra, and directed the government to follow RP 2021.
