'Turn' of events: Kenneth Silveira in a pickle; faces questioning in land deal

PANAJI: Kenneth Silveira, who shot into limelight twice, albeit unsuccessfully, contested state assembly elections, and more recently produced a viral video against Chief Minister Manohar Parrikar's U-turn on casinos, is facing a state level inquiry into an alleged fraudulent land deal.
Silveira had bought a piece of land from Francy Agnelo Gonsalves measuring 74,800 square meters at Casarvornem village in Pernem taluka. However, the land belonged to one Laxmibai Ganesh Madval who allegedly executed a power of attorney in favour of Gonsalves, which was executed after Madval passed away.
Gonsalves entered into a deed of sale with Kenneth Silveira for sale of the entire land which was executed in 2010. After land acquisition proceedings for the upcoming Mopa airport were completed and the land in question was acquired, Silveira received a compensation to the tune of Rs 49-lakh following an order from the District Judge at Mapusa. This despite a complainant pointing out that at the time that Silveira bought the land, Section 6 of the Land Acquisition Act had already been enacted, which would have ideally meant that the land could not have changed hands.
After the initial compensation, Silveira was due to receive three times enhanced compensation.
In his professional opinion and after having perused the file, Advocate General Dattaprasad Lawande has said that the order of additional compensation which Silveira was due for should be cancelled.
"I would rather feel that this is a matter for police investigation inasmuch as the special land acquisition officer noted that Laxmibai Madval has expired. However, in the order passed by District Judge, it is recorded... that Madval (was) represented by her power of attorney Francy Gonsalves. The question therefore arises is: ‘How can a person who is already dead, be represented by the power of attorney?" The Attorney General said.
Silveira has meanwhile filed a case before the Bombay High Court at Goa that the compensation should be released to him as per the order of the North Goa District Judge at Mapusa which is pending before the tribunal.
The Advocate General in his opinion also said that he failed to understand how, based on a notarized power of attorney, the sub-registrar executed the sale deed when in fact the power of attorney does not mention that there is power to sell on behalf of the owner, while suggesting that the State should contemplate challenging the order passed by the District Judge.
