Expressing concern over the Governor's assent to what it called as a "draconian" Goa Compensation to the Project Affected Persons & Vesting of Land in the government Bill, 2017, the Goans for Dabolim Only (GFDo) has petitioned to the Goa governor to direct the government to withdraw
‘Clause 4' of the Bill immediately, directly or by way of ordinance so that the Act cannot be abused under the garb of Compensation.
Reminding that the Governor is the state custodian of the Constitution, the petition has also requested the governor to ensure that the government does not pass any law that violates the Constitution of India.
Addressing the media, GFDO Convenor Fr Eremito Rebello said the petition has also appealed to the governor to show some respect for the judicial processes of the nation and the Constitutional rights of its people by withdrawing the police force posted at the Mopa plateau.
Fr Rebello said the governor has been requested to ensure forthwith stopping of all work related to the Mopa airport and its approach road, until the pending cases have been decided in the various courts of law.
Fr Eremito questioned the state government's move to pass the Compensation Bill when there already exists a central Act called Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, which more than adequately fulfills the purpose of ensuring that all the owners and tenants will be compensated fairly and adequately.
"This Central Act was passed after two years of deliberation in the Parliament and was
Amended in the Goa Assembly on April 21, 2015.
Under the central Act, it was mandatory for the government to consult institutions of local self-government and gram sabhas established under the Constitution and it ensures a humane, participative, informed and transparent process for land acquisition for required the industrialization and development of essential infrastructure", Fr Eremito added.
