The Goa government has issued guidelines for the appointment and functioning of support persons for child victims under the Protection of Children from Sexual Offences (POCSO) Act, 2012.
The new framework is intended to ensure emotional and psychological support for children below the age of 18 who are victims of sexual offences. It mandates the involvement of trained professionals, non-governmental organizations and experts in psychology, social work, physical and mental health and child development to assist children during pre-trial and trial proceedings.
The notification, published on Thursday, cited Section 39 of the POCSO Act that mandates state governments to prepare such guidelines for the involvement of experts and support personnel.
“The responsibility of supporting children who have been sexually abused or have been a victim of abuse should be embraced by the whole community. Therefore, the professionals who are working in this field play a key role in enabling the healing process,” the objective formulated by the Directorate of Women & Child Development stated.
Under the guidelines, support persons are to be appointed by the Child Welfare Committee in accordance with Rule 4(8) of the POCSO Rules, 2020; and are expected to assist the child throughout the investigation and court proceedings.
“These individuals play a crucial role in helping children to cope with the legal system and to provide them with the support they need to effectively testify against their offenders. Therefore, proper rehabilitation of the victim plays a crucial role in ensuring protection,” it added as the government has also released a long list of requirements for the appointment of a support person.
