CANACONA
A woman and her son from Agonda have been booked for trademark violations, by operating a resort, spa and restaurant under an identical name of ‘Simrose Beach Resort’.
According to Canacona police, a complaint was filed by Prashant Kankonkar and Binesh Thapa, both directors of Simrose Resort Pvt Ltd, Canacona.
They accused Selvin Fernandes and Simrose Fernandes and other unknown persons of illegally operating a resort, spa and restaurant under the identical name of ‘Simrose Beach Resort’ at Agonda from May 31, 2024 to till date, without any authorisation or permission from the complainants.
The complainants also alleged that the accused utilised digital platforms like Facebook, Instagram, website and booking portals with names resembling ‘Simrose Beach Resort’ to accept booking, which caused confusion among tourists.
This also resulted in financial loss, while also infringing the trademark, committing identity theft, the complainants alleged.
Canacona police have registered FIR under Sections 103, 104 of trademark Act, Sections 66 C & 66 D of IT Act and Sections 318, 320 r/w 34 BNS. Further investigation is being carried out by Canacona PI Harish Raut Dessai.
