South Goa Additional Collector-I Srinet Kothwale has said the District Administration is aware of the matter pertaining to the demolition of the house on Comunidade land at Verna and will intervene and facilitate to provide all necessary assistance to family members for their rehabilitation, etc.
The Additional Collector, however, said the news that has gone viral on social media that the State Government has displaced the said person is not correct.
He asserted that the demolition exercise was not carried out by the State Government or District Collectorate but the same was carried out by the Office of the Administrator of Comunidades of South Zone, Margao in its routine demolition exercise as its statutory duties and court directives.
Referring to the demolition carried out at Verna on the land belonging to the Communidade of Verna, the Additional Collector-I has clarified that the demolition of illegal structure erected on the land belonging to the Comunidade of Verna, under Survey No. 48/0 had been carried out based on final order in Case No. 1/37/Verna/2012-2013/455 dated 21/08/2012 passed by the Administrator of Comunidades of South Zone, Margao.
Giving a chronology of events before the final demolition of the structure, the Additional Collector, in a press release, said the action against the structure started after a complaint was lodged by a resident of Verna on August 25, 2006.
The Managing Committee President Jose Bosco Fernandes, Comunidade of Verna, in its meeting dated 25/08/2006 has resolved that they have inspected the site of encroachment and requested the Administrator of Comunidade may take immediate action in the matter.
Based on the above resolution, he said the office of the Administrator of Communidade of South Zone, Margao has issued notice under Art. 371 r/w 372 and directed the encroacher Remediana Castanha to vacate the said land by 23/10/2006 or to appear in the office of the Administrator to Show cause on 24/10/2006 at 10.30 AM that why she should not be evicted under Art 371 of the Code of Communidade.
Kothwale further stated that after hearing the encroacher, Office of the Administrator of Communidade of South Zone, Margao has issued Final Order in case No. 1/37/Verna/2007-2008/125 dated 06/06/2007 to Remediana Castania, r/o H.No. 126/D, Old Mardol, Verna, Salcete- Goa to demolish/remove the illegal structure erected on Comunidade of Verna land under Survey No. 48/0 of Village Verna of Salcete Taluka.
“Thereafter, office of the Administrator of Communidade of South Zone, Margao issued another Final Order in Case No. 1/37/Verna/2012-2013/455 dated 21/08/2012 to Remediana Castania r/o H.No., 126/D, Old Mardol, Verna, Salcete-Goa to demolish/remove the illegal structure erected on Communidade of Verna land under Survey No. 48/0 of Village Verna of Salcete Taluka.
Based on the above Order, office of the Administrator of Communidade of South Zone , Margao vide letter dated 28/09/2012 has requested the Dy. Collector & SDO in charge of demolition squad, Margao to provide the demolition squad for carrying out the demolition of the above illegal structure . The demolition squad was provided and the demolition was fixed on 05/02/2013. The said demolition squad was called from the site of encroachment due to direction of the Court to maintain status quo in Regular Civil Suit No. 29/2013/I, the press release stated.
The encroacher Remediana Castania & Rama Waddar both r/o H. No. 126/D, Near Mahalsa Goddess Temple, Mardol, Verna, later preferred a suit before the Court of the Adhoc Ist Addl. Senior Civil Judge, Margao praying for declaration of the title by virtue of adverse possession and the other reliefs that are consequential in nature. The Regular Civil Suit No.29/2013/1 was rejected on 24/10/2018, he said.
The Comunidade of Verna vide letter dated 05/02/2022 has requested the Joint Secretary (Revenue) & by subsequent letter dated 01/09/2022 to the Office of the Revenue Minster, Secretariat to execute the order of demolition.
Based on the above, the Office of the Administrator of Comunidades of South Zone, Margao has requested the Dy.Collector & SDO, in Charge of Demolition Squad, Margao to provide the demolition squad to carry out demolition of above illegal structure before the structure was finally demolished on September 6.
