Velsao villagers await court hearing on double-tracking dispute

A group of Velsao villagers gathered at the South Goa District Court on Wednesday, anticipating a hearing on the petition filed by residents seeking a stay on the ongoing double-tracking works carried out by Rail Vikas Nigam Ltd.

The hearing, however, could not take place, and the matter was adjourned to the next date on March 15.

The plaintiffs had filed a suit for a permanent injunction under Section 39 of the Specific Relief Act against the South Western Railway, Rail Vikas Nigam Ltd, and the contractor undertaking the work in the village.

They had prayed to the South District Court to issue a decree and judgment permanently injuncting the SWR, RVNL, and the contractor from entering, trespassing, or encroaching on the property in question. They had further prayed to the court to issue a judgment directing the railways, by mandatory injunction, to restore the property to its original state, clear the roadblock, and remove the blockage of natural waterways and drains.

In the petition, they claimed that although the South Western Railways runs its trains and maintains a railway track, it has never acquired any right to the property/land on which it runs or even the property on both sides of the tracks parallel to the suit property.
